Derive Proposes a US-Regulated Derivatives Push With No Spending Cap

Derive's governance forum carries a proposal to fund a US-regulated derivatives venue. The document sets no spending figure, no launch date or named regulator.

Derive's governance forum carries a proposal to take the protocol into US regulated derivatives markets, and it does not name a spending figure. The post, titled "DIP: Expand Derive into US Regulated Markets", was published on October 12, 2026 at 1:07pm by Ian, and authorizes the Derive Foundation and its subsidiaries to explore and pursue legal and regulatory pathways for bringing Derive's derivatives infrastructure into the United States.

The Foundation is authorized to allocate limited existing treasury assets to this work.

That is the entire funding clause. There is no dollar amount, no token amount and no cap anywhere in the document. Material capital commitments beyond the exploratory and implementation phase would come back for separate consideration "once the regulatory pathway and associated requirements are clearer", the proposal says.

The Mandate Covers Registrations and Entities, Not a Launch

The scope is wider than a single filing. The Foundation may "explore and pursue the registrations, approvals and other legal pathways required to establish regulated Derive market infrastructure in the United States", and may "establish, acquire, restructure or capitalize entities where reasonably necessary to pursue those pathways".

It also names engaging US regulators directly. Derive says it has already begun engaging with US regulators and advisers to explore how its technology can support a fully regulated US derivatives venue.

The document does not name a regulator, does not specify a registration category and does not describe any filed application or agreement.

One operational detail explains the shape of the ask: the authority is written to let the Foundation handle routine legal, regulatory and implementation spending without returning for a separate governance vote each time.

The Offshore Venue Stays Offshore

The US plan is described as running alongside the existing international venue, which "continues to develop as a DeFi-focused market for eligible non-US participants". The proposal adds a regulated US counterpart rather than moving the current product.

On ownership, the Foundation says it will seek to preserve its ownership and stewardship of the core Derive technology and intellectual property, and to ensure that any regulated US business using that technology does so under appropriate commercial arrangements.

Derive's own site describes the protocol as "an optimistic rollup settling to Ethereum". Its homepage showed cumulative figures of $40.78 billion in volume, $10.11 million in revenue and 5.08 million trades at the time of reading.

What the Vote Does Not Decide

The proposal lists its own exclusions:

  • The final corporate, ownership or intercompany structure for the US initiative.
  • A particular regulatory registration or approval.
  • A specific launch date.
  • Completion of a US launch if the regulatory, legal or commercial conditions are not satisfactory.

The last item is the one to hold on to. The mandate authorizes spending on a pathway, not a venue, and the document itself keeps the option of no US launch at all open.

The Market the Proposal Cites

For scale, the proposal cites the global over-the-counter derivatives market at approximately $846 trillion in notional value outstanding as of June 2025, with a gross market value of about $22 trillion. OTC interest-rate derivatives alone traded at an average of about $7.9 trillion per day in April 2025, including around $2 trillion per day through US dealing desks.

Its argument from those numbers is that much of the infrastructure supporting regulated derivatives trading, clearing, settlement and collateral management "remains built on traditional financial rails".

Governance on Derive runs through the Agora portal, where DRV stakers delegate and vote. At the time of reading, the proposal did not appear in the Agora proposals list and the forum thread showed no replies or poll result.
