Democrats Target Crypto Rules With Bigger SEC Role After Midterm Wins

Democrats are preparing a new crypto regulatory proposal after their midterm victories, potentially expanding SEC oversight, reviving investor protections and introducing ethics restrictions for government officials.

Democrats plan new crypto regulations

Democrats are preparing to reshape US cryptocurrency regulation after winning control of both chambers of Congress in the 2026 midterm elections. House lawmakers are reportedly discussing a new crypto market-structure proposal that would expand the Securities and Exchange Commission's (SEC) authority, strengthen investor protections and introduce ethics restrictions targeting President Donald Trump and other federal officials.

The discussions could mark a significant shift from the Republican-led approach to digital asset regulation over the past two years. Democrats will take control of Congress in January 2027, while Senator Elizabeth Warren is expected to become chair of the Senate Banking Committee.

However, the proposed legislation remains at an early stage. No formal bill text has been released, and the reported plans are based on information shared by industry sources familiar with discussions among Democratic staffers.

House Democrats Consider Expanding SEC Oversight

The proposed legislation could revive elements of Representative Maxine Waters' Crypto Investor and Consumer Bill of Rights and combine them with provisions previously considered during negotiations over the Digital Asset Market Clarity Act, commonly known as the CLARITY Act.

One major issue is how regulatory authority would be divided between the SEC and the Commodity Futures Trading Commission (CFTC).

The proposal reportedly favours giving the SEC a larger role in supervising cryptocurrency markets, potentially reducing the CFTC's authority over parts of the industry.

This would matter for cryptocurrency exchanges, token issuers and other digital asset businesses because the two agencies have different regulatory responsibilities. A broader SEC role could mean more securities-related compliance requirements and closer oversight of crypto platforms.

The plan also seeks to bring back investor-protection measures that Democrats argued were missing from earlier legislation.

Altcoin Buzz previously reported on House Democrats weighing a crypto bill that would give the SEC more power, including the proposal to revive Waters' earlier consumer-protection framework.

Trump-Related Ethics Rules Could Become a Major Obstacle

Another important part of the reported proposal involves ethics restrictions for government officials.

Democrats have previously raised concerns about President Trump's cryptocurrency-related business interests and potential conflicts of interest. The proposed framework could restrict the president, vice president, members of Congress and other federal officials from engaging in certain crypto-related commercial activities.

These restrictions could become a major point of disagreement between Democrats and Republicans.

Democrats have argued that public officials should not be able to influence financial regulation while maintaining personal business interests in the industries they oversee. Republicans, meanwhile, have pushed back against provisions they consider politically motivated.

The ethics debate also played a role in the CLARITY Act negotiations. In September, the Senate failed to advance the legislation after a procedural vote ended 49-50, leaving the bill stalled in the current Congress.

Elizabeth Warren Could Take a Stronger Role in Crypto Oversight

The Democratic victory in the Senate also puts Senator Elizabeth Warren in line to lead the Senate Banking Committee when the new Congress begins.

Warren has frequently criticised the cryptocurrency industry and called for stronger consumer protections, anti-money-laundering safeguards and oversight of digital asset businesses.

As committee chair, she would gain greater influence over hearings, investigations and financial legislation. The committee also plays an important role in overseeing banking and financial regulators, including matters affecting the crypto industry.

Warren's expected appointment could therefore bring increased scrutiny of cryptocurrency firms, banks offering digital asset services and federal agencies responsible for regulating the sector.

However, her position does not automatically mean every proposed restriction will become law. Legislation would still need to pass both chambers and receive presidential approval.

What Happens to The CLARITY Act?

The political shift creates fresh uncertainty for the CLARITY Act, which passed the House in July 2025 but failed to advance in the Senate.

The bill sought to establish clearer rules for digital asset markets and divide responsibilities between the SEC and CFTC. Its supporters argued that clearer regulatory boundaries would help cryptocurrency businesses operate in the United States.

Democrats have indicated that they want stronger investor protections and ethics provisions before supporting a broader market-structure framework.

There may still be room for bipartisan negotiations. Some Democratic lawmakers support clearer crypto rules, and industry representatives have argued that regulatory certainty remains important regardless of which party controls Congress.

Altcoin Buzz previously explained how the Democratic Senate victory puts the CLARITY Act on a deadline before January 3. If the bill does not advance before the new Congress convenes, it will need to be reintroduced.

For the cryptocurrency industry, the next few months could determine whether the United States moves toward a bipartisan regulatory framework or a more restrictive approach led by Democratic priorities. The first concrete indication will be the publication of formal legislation and the specific powers it proposes to give the SEC.
