Ripple and SEC Call Truce in XRP Legal Battle

Ripple and SEC Call Truce in XRP Legal Battle

Ripple Labs and the U.S. Securities and Exchange Commission (SEC) have jointly agreed to drop their appeals. The lawsuit centered on whether the XRP token should be treated as a security.

After nearly four years of legal sparring, both parties filed with the Second Circuit Court of Appeals to dismiss their respective appeals, with each covering its costs.

A Years-Long Fight Over XRP

The SEC first sued Ripple in late 2020, alleging that the company sold XRP as an unregistered security in violation of federal law. The case quickly became a bellwether for how U.S. regulators might treat cryptocurrencies. In July 2023, Judge Analisa Torres issued a mixed ruling: XRP sales on public exchanges did not meet the legal definition of a security, but sales to institutional investors did. She ordered Ripple to pay $125 million in fines—a far cry from the SEC’s $2 billion request.

Both sides appealed, setting the stage for another round of legal battles. However, in April this year, they asked to pause the appeals process. Ripple hinted that a resolution was on the horizon, and by May, the two sides reached a settlement. Judge Torres denied Ripple’s request to dissolve the injunction or reduce the fine, stressing that the company must still follow securities laws. Now, with the appeals dropped, her 2023 decision stands as the final word.

This legal closure comes at a time when the political climate around crypto regulation is shifting. Under President Donald Trump’s current administration, the SEC has pulled back from aggressive enforcement, dropping multiple lawsuits against blockchain companies.

What This Means for Crypto Regulation

The Ripple-SEC resolution could have ripple effects—pun intended—on the broader industry. While it doesn’t create binding precedent for other cases, it underscores a growing willingness by regulators to compromise, especially as political and public pressure mounts for clearer rules.

For example, many tokens currently operate in a gray area where their classification as securities remains unclear. The outcome for XRP means exchanges can list it with more confidence, potentially restoring liquidity and boosting adoption. It also signals to other projects that a strong legal defense and a willingness to negotiate can lead to workable outcomes, even against a powerful regulator.

The crypto space has seen similar settlements in the past year, reflecting a trend toward regulatory détente rather than all-out confrontation.
