White House warns CLARITY Act could fail without Democratic support

The White House is increasing pressure on Senate Democrats ahead of the September 15 CLARITY Act vote, warning that the crypto market structure bill could fail if lawmakers cannot secure enough bipartisan support.

Patrick Witt, executive director of the Presidential Council of Advisors for Digital Assets, argued that Congress has already had enough time to negotiate the legislation. He said lawmakers have been working on crypto market structure rules for years and that Senate negotiations over the CLARITY Act have continued for nearly a year.

Witt suggested that if lawmakers cannot reach an agreement by September 15, getting the bill through Congress could become even more difficult.

CLARITY Act Faces a 60-Vote Test on September 15

Senate Majority Leader John Thune has filed cloture on the motion to proceed with the CLARITY Act, setting up a procedural vote for September 15. However, the vote will not be a final vote on the CLARITY Act.

Instead, senators will decide whether to end debate on the motion to proceed and allow the Senate to begin formally considering the legislation.

The procedural vote is important because the Senate generally needs 60 votes to invoke cloture.

Republicans currently hold 53 Senate seats, meaning they would need at least seven Democratic votes if all Republicans support the motion.

Republicans Say Negotiations Have Gone on Long Enough

Republican Sen. Bernie Moreno has also increased pressure on Democrats ahead of the September vote.

Moreno said he expects all 53 Republican senators to support cloture. If that happens, at least seven Democrats would need to vote in favor of advancing the bill.

He also argued that negotiations should now be considered finished after months of discussions between Republicans and Democrats.

According to Moreno, lawmakers have spent roughly 11 months negotiating the legislation, and the remaining question is whether Democrats will support moving the bill forward.

This creates a different challenge for Senate leaders. Rather than simply negotiating another agreement, they now need to determine whether enough Democrats are willing to support the existing proposal.

Ethics and Stablecoin Rewards Remain Key Issues

The CLARITY Act has already passed an important committee stage.

The Senate Banking Committee advanced the bill by a 15-9 vote in May, with two Democrats joining Republicans.

However, negotiations continued afterward, particularly around ethics rules and stablecoin rewards.

Democratic lawmakers have pushed for stronger conflict-of-interest rules covering elected officials and government officials with crypto-related businesses.

The issue has received additional attention because of President Donald Trump's family's involvement in the digital asset industry.

Banks and crypto companies have also disagreed over rules governing rewards linked to stablecoin balances.

These disagreements have made it difficult for Senate leaders to secure the bipartisan support needed to move the legislation forward.

White House Says US Could Lose Its Crypto Lead

The debate over the CLARITY Act is also tied to a broader question about the future of the US crypto industry.

Moreno has argued that the legislation could help determine whether the US maintains its position as a major center for digital asset innovation or falls behind international competitors.

The White House has similarly pushed for progress on crypto legislation, arguing that clearer market rules could give businesses and investors more certainty.

The concern is that prolonged regulatory uncertainty could encourage crypto companies and capital to move toward jurisdictions with clearer digital asset frameworks.

What Happens If the September 15 Vote Fails?

A failure to reach the 60-vote threshold on September 15 would not technically kill the CLARITY Act.

However, it would be a major setback for the legislation and could raise doubts about whether Congress can pass a comprehensive crypto market structure bill in 2026.

If all 53 Republicans support cloture, the bill would need at least seven Democratic votes to advance.

That makes the September 15 vote a critical test of bipartisan support for US crypto regulation.

For the crypto market, the outcome could also influence expectations around regulatory clarity, institutional participation and the future of digital asset businesses in the United States.
