Bessent Urges Senate to Advance CLARITY Act Ahead of Sept. 15 Vote

Treasury Secretary Scott Bessent is urging the Senate to advance the CLARITY Act before the September 15 procedural vote, framing the legislation as a tool for crypto regulation, enforcement and national security.

Bessent Pushes Senate on CLARITY Act

U.S. Treasury Secretary Scott Bessent is urging the Senate to keep the CLARITY Act moving, warning that failure to advance the legislation would signal that the United States is unwilling to lead on digital assets or strengthen its ability to combat their misuse.

Bessent made the appeal on September 9, just days before the Senate's scheduled September 15 procedural vote on H.R. 3633, the Digital Asset Market Clarity Act. He called on senators to remain at the negotiating table, agree to the motion to proceed and continue working on the legislation.

The intervention gives the upcoming vote additional importance. Bessent is no longer presenting CLARITY solely as a market-structure bill. His latest argument focuses on national security, enforcement and America's position in the global digital-asset industry.

Sept. 15 Vote Is Not Final Passage

The September 15 vote is a cloture vote on the motion to proceed to H.R. 3633, rather than a final vote on the CLARITY Act itself. The Senate has officially scheduled the cloture proceeding for approximately 2:15 p.m. ET on September 15.

If cloture succeeds, the Senate can move toward formally considering the bill. It would not mean that CLARITY has passed Congress. The legislation would still face debate, amendments and additional procedural votes before Senate passage, followed by the need to reconcile the legislation with the House.

The vote is particularly challenging because Republicans hold 53 Senate seats, meaning the party needs support from Democrats or independents to reach the 60-vote threshold normally required for cloture. Reuters reported that both crypto advocates and banking groups have intensified lobbying efforts ahead of the vote, highlighting how consequential the September deadline has become.

Why Bessent Is Framing CLARITY as a Security Issue

Bessent's latest warning centers on the government's ability to prevent bad actors from exploiting digital-asset technology.

The Treasury secretary said the bill would establish a comprehensive regulatory framework while improving the government's ability to combat misuse of digital assets. His position aligns with arguments from supporters who say clearer regulatory responsibilities could give U.S. agencies stronger tools to address illicit finance while allowing legitimate crypto businesses to operate under defined rules.

The national-security argument is also being contested. Senate Banking Committee Democrats have argued that the current CLARITY text leaves vulnerabilities involving illicit finance, foreign adversaries and criminal activity. A minority-staff analysis released in August specifically criticized the bill's treatment of several potential national-security and enforcement gaps.

That disagreement means the September vote is not simply a question of whether senators support crypto regulation. It is also a debate over what regulatory and enforcement structure should govern the industry.

CLARITY Act Already Cleared Two Major Hurdles

The legislation has already made significant progress through Congress. The House passed H.R. 3633 by 294-134 in July 2025, including support from 78 Democrats.

In May 2026, the Senate Banking Committee advanced the bill in a 15-9 bipartisan vote after months of negotiations. The committee said the legislation is intended to establish clearer rules for digital assets while strengthening consumer protections and tools against illicit finance.

Senate negotiators subsequently worked to merge the Banking and Agriculture Committee approaches. Sen. Cynthia Lummis released updated CLARITY Act text in July and described the period ahead as potentially the last realistic opportunity for years to establish a federal digital-asset framework.

That progress has not eliminated the remaining disagreements.

The September Window Is Extremely Tight

Even if the Senate clears the procedural hurdle on September 15, lawmakers have limited time to complete the process.

The House is scheduled to leave Washington around September 17, creating a narrow window for the two chambers to resolve any differences before the midterm election period. Recent reporting has therefore raised concerns that a failed procedural vote could effectively push comprehensive market-structure legislation beyond the current congressional window.

Prediction markets also remain cautious. CoinMarketCap reported that traders were pricing the probability of the CLARITY Act becoming law in 2026 at around 16%, underscoring the uncertainty surrounding the legislation despite renewed political pressure.

What Happens on Sept. 15?

For crypto markets, September 15 should be viewed primarily as a procedural binary event, not a final verdict on U.S. crypto regulation.

A successful cloture vote would keep CLARITY alive and give negotiators another opportunity to resolve the remaining disputes. A failed vote would make passage during the current congressional window far more difficult.

Bessent's intervention shows how seriously the administration views that deadline. By linking CLARITY to national security, law enforcement and America's position in digital assets, Treasury is now putting additional pressure on senators to keep the legislation moving.

For the crypto industry, the immediate question is therefore not whether the CLARITY Act becomes law on September 15. It is whether senators can secure enough support to keep the bill alive long enough to finish the much larger fight over America's crypto market structure.
